PANDANGAN TOKOH AGAMA TERHADAP HUKUM PENJUALAN BENDA WAKAF BEKAS RERUNTUHAN LANGGAR DI KECAMATAN SUNGAI TABUKAN KABUPATEN HULU SUNGAI UTARA

Abstract

This research discusses the practice of selling ruins of used waqf objects and how religious figures view the law of selling used waqf objects in Sungai Tabukan District, Hulu Sungai Utara Regency. The subjects of this research are community leaders and religious leaders of Sungai Tabukan Sub-District, Hulu Sungai Utara Regency, while the object of research is the views of religious leaders on the law of selling waqf objects used as Langgar ruins in Sungai Tabukan Sub-District, Hulu Sungai Utara Regency. To collect data in the field, observation, interviews, documentation techniques are used, then to analyze the data the author uses qualitative analysis. The results of this study conclude that the practice of selling waqf objects of Langgar ruins is for the benefit of the Langar. Therefore, the waqf management committee sold these objects with the proceeds going back to the Langgar. This is because when the Langgar was demolished, many waqf objects were unused and wasted, some of which caused losses to the waqif. This is in accordance with the fatwa of the Indonesian Ulama Council (MUI). In Islamic law, there are different opinions about the replacement of waqf objects. According to Iman Syafi'I, Iman Maliki, Imam Hanafi it is not allowed to replace assets that have been endowed, while according to Imam Hambali, it is allowed to replace waqf objects because they are no longer considered useful..
